Resigning from an employment contract: notice and form
Last updated: July 2026Under the Swiss Code of Obligations, after probation the notice period is one month in the first year, two months from the second to the ninth year and three months from the tenth year – each to the end of a month. During probation the period is usually seven days. What always applies is your employment contract or an applicable collective bargaining agreement (CBA), provided it meets the statutory minimums.
Resignation is in principle not bound to a form but should be in writing so the date and content are provable. For the start of the period, receipt by the employer counts, not the postmark. Keep the letter factual: name, date, a clear intention to resign and the desired end date are enough. No reason is required.
Recommended shipping method
Because receipt by the employer determines the start of the period, we recommend sending by registered mail (from CHF 8.99). That gives you proof of posting and of timely resignation. This is a recommendation, not a legal obligation.
This information is provided as drafting help only and does not constitute legal advice. Deadlines and formal requirements can vary by contract, policy or canton – if in doubt, check with the relevant body.

Common questions
How long is the notice period in an employment contract?
After probation the statutory notice is one month in the first year, two months from the second and three months from the tenth year – each to month-end. Your contract or CBA may provide otherwise.
Do I have to give a reason?
No. No reason is required. A clear intention to resign with the desired end date is enough.
Does the postmark or receipt count?
For the start of the period, receipt by the employer counts, not the postmark. So plan for postal transit and send in good time.
Should I resign in writing?
Resignation is in principle free of form, but a written resignation is recommended so the date and content can be proven.
How should I send the resignation?
We recommend registered mail (from CHF 8.99) so you have proof of posting. Simple sending is possible from CHF 2.49.
