These General Terms and Conditions ("Terms") govern the use of the SwissDocs24 service. By using the service, you accept these Terms in full. If you do not agree, you must not use the service.

2. Description of Service

SwissDocs24 provides a web-based platform for:

Online preparation of letters (via upload or online editor)
Transmission of letters to a third-party print/mailing provider (currently Pingen) for printing and enveloping
Handover to postal carriers (currently Swiss Post) for physical delivery

IMPORTANT: SwissDocs24 is NOT a postal operator. We act solely as an intermediary between you and third-party service providers. The actual printing, enveloping, and delivery is performed by independent third parties over whom we have no control.

3. No Delivery Guarantee

WE DO NOT GUARANTEE:

That letters will be delivered
That letters will be delivered on time
That letters will be delivered to the correct recipient
The quality of printing or physical condition of letters upon arrival
Any specific delivery timeframe or date

All production and delivery timelines shown are estimates only and are not binding. Actual processing and delivery times depend entirely on third-party providers and postal carriers, which are outside our control.

4. Risk Transfer

All risk relating to letters transfers to the print/mailing provider upon successful transmission from our platform. We are not responsible for any loss, damage, delay, or non-delivery occurring after this point.

5. User Eligibility & Obligations

By using SwissDocs24, you confirm that:

You are legally capable of entering into contracts under applicable law
You provide accurate and complete sender and recipient information
You are the sender or are duly authorized to send on behalf of the stated sender
You are solely responsible for the legality, accuracy, and appropriateness of all content
You will keep your login credentials secure

6. Prohibited Content

You may NOT use SwissDocs24 to send:

Illegal, threatening, harassing, defamatory, or fraudulent content
Racist, discriminatory, or hate speech
Pornographic or obscene material
Unsolicited advertising or spam
Content infringing third-party rights (copyright, trademark, privacy)
False or misleading information
Content under false identity or as an unauthorized third party
Malware or harmful code
Anything prohibited by Swiss law or the law of the recipient's country

We reserve the right to refuse, cancel, or report any order we believe violates these rules, without refund and without prior notice.

7. Content Responsibility

You are solely and exclusively liable for the content of your letters. We do not review, approve, or endorse any content. We accept no liability for any claims, damages, or legal consequences arising from your letter content.

8. Prices & Payment

Prices shown at checkout apply at the time of order
Payment is due immediately upon order placement
We accept payments via Stripe (credit cards and other methods as shown)
All prices include applicable Swiss VAT where required
Non-Swiss customers may be subject to additional taxes or duties at their end
Prices may change without notice; the price at order time is binding

9. Withdrawal / Cancellation

Production starts immediately after submission. Orders cannot be cancelled, modified, or refunded after submission, except where mandatory consumer rights provide otherwise. If you are an EU consumer, you expressly request and consent to immediate performance and acknowledge that the withdrawal right may lapse once processing starts, to the extent permitted by law.

10. Service Availability

The service is provided on an "AS-IS" and "AS-AVAILABLE" basis, subject to mandatory consumer protections. We do not guarantee:

Uninterrupted or error-free operation
Availability at any specific time
Preservation of any data beyond stated retention periods

We may modify, suspend, or discontinue the service or any features at any time without notice or liability, except where mandatory law provides otherwise.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

We exclude liability for slight negligence.
We exclude liability for indirect, incidental, special, or consequential damages; loss of profit, revenue, business, or data; acts, errors, delays, or omissions of third-party providers (Pingen, Swiss Post, payment processors); non-delivery, delayed delivery, incorrect delivery, or damage to letters; content or addressing errors you provide; service interruptions, technical failures, or data loss.

Carve-outs: These exclusions do not apply in cases of intent or gross negligence, personal injury, or other mandatory statutory liability.

Cap: Where liability cannot be excluded, our total aggregate liability is limited to (a) for consumers: the amount paid for the affected order, capped at CHF 25; (b) for business users: the amount paid for the affected order, capped at CHF 100; in each case only to the extent permitted by law.

Third parties: Delivery issues are primarily handled with the carrier or print/mailing partner; we support on a best-effort basis but are not responsible for their actions beyond what mandatory law requires.

12. Indemnification

You agree to defend, indemnify, and hold harmless SwissDocs24, Top Line Electronic GmbH, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from:

Your use of the service
Your letter content
Your violation of these Terms
Your violation of any third-party rights
Any claims by letter recipients

13. Intellectual Property

All intellectual property rights in the SwissDocs24 platform, website, software, and documentation belong to Top Line Electronic GmbH. You retain ownership of your letter content but grant us a limited license to process and transmit it for service fulfillment.

14. Data & Privacy

Data processing is governed by our Privacy Policy. By using the service, you consent to the processing described therein. We retain files for 30 days after processing, after which they are automatically deleted.

15. Account Termination

We may suspend or terminate your account at any time, with or without cause, with or without notice. You may delete your account at any time. Termination does not affect orders already submitted or your payment obligations.

16. Amendments

We may amend these Terms at any time by posting the updated version on our website. Continued use after changes constitutes acceptance. The Terms in effect at the time of your order apply to that order.

17. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.

18. Governing Law & Jurisdiction

Governing Law: These Terms are governed exclusively by Swiss law, excluding conflict of law rules and the UN Convention on Contracts for the International Sale of Goods (CISG), and subject to any mandatory consumer protections.

Jurisdiction: The exclusive place of jurisdiction for all disputes is Aarau, Switzerland, except where mandatory statutory provisions require a different venue.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SwissDocs24 regarding use of the service.
