How to give notice on your flat correctly
Last updated: July 2026As a tenant you can terminate the lease by observing the notice period and the dates set in the contract. By law, flats have a minimum notice period of three months unless the lease provides for a longer one. What matters is that the notice reaches the landlord by the day before the period begins at the latest – here too it is receipt that counts, not the postmark.
If it is the family home (marriage or registered partnership), both people must sign the notice, otherwise it is invalid. No official form is required for a termination by the tenant – written form is enough. For an early move-out, a solvent replacement tenant is usually required; a separate template exists for that.
