Cancelling a parking space: which notice period applies
Last updated: August 2026What matters is whether the parking space is rented separately or belongs to the flat. If it has its own lease, Art. 266e CO sets a statutory period of two weeks to the end of a one-month rental period. That period is a minimum: under Art. 266a para. 1 CO it only applies where the parties have not agreed a longer period or a different term. In practice, parking contracts often state one or three months to a month end. So read the contract first and go by the longer of the two.
If the parking space is part of the flat's lease, do not cancel it separately: the flat's lease applies, and for dwellings the law sets three months to a locally customary term (Art. 266c CO). Missing the deadline loses nothing permanently: under Art. 266a para. 2 CO a cancellation that misses the period or term takes effect on the next possible term. State the space number, the address of the parking space and the end date you want, and ask where and when to return a key, badge or remote control.
